We may participate in affiliate marketing, referral, influencer, creator, publisher, or similar programs, including the Amazon Associates Program and other comparable programs that may be available from time to time.
Any opinions, recommendations, reviews, observations, or endorsements expressed through the Services are based on our own views and experiences unless expressly stated otherwise. However, you acknowledge that the existence of an affiliate relationship may result in compensation to the Company when you purchase through certain links.
Affiliate links may appear on the Site, in newsletters, emails, educational materials, courses, social media content, presentations, webinars, downloadable resources, or other communications associated with the Services. We encourage you to conduct your own evaluation before purchasing any third-party product or service.

The Privacy Policy applies to information collected through the Services and communications with the Company, including newsletter subscriptions, contact forms, speaking inquiries, downloadable resources, course registrations, and purchases.
If these Terms conflict with the Privacy Policy regarding a privacy matter, the Privacy Policy controls.
Individuals outside the United States may access the Services, and information they provide may be transferred to and processed in the United States.
18. Copyright Complaints
If you believe material available through the Services infringes your copyright, send a written notice to info@ascendconsultingdc.com containing the following information:
Identification of the copyrighted work you claim has been infringed.
Identification and location of the allegedly infringing material.
Your name, mailing address, telephone number, and email address.
A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or applicable law.
A statement that the information in your notice is accurate and that you are authorized to act for the copyright owner.
Your physical or electronic signature.
We may remove or restrict access to disputed material while reviewing a complaint and may notify the person who provided the material. Knowingly submitting a materially false infringement notice may have legal consequences.
19. Disclaimer of Warranties
To the fullest extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. The Company disclaims implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, and uninterrupted or error-free operation.
We do not warrant that the Services will always be available, secure, complete, accurate, current, or free of harmful components.
20. Limitation of Liability
To the fullest extent permitted by law, the Company and its owners, officers, employees, contractors, agents, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, opportunities, goodwill, data, or business interruption, arising out of or relating to the Services or these Terms.
To the fullest extent permitted by law, the Company's aggregate liability arising from or related to the Services or these Terms shall not exceed the greater of (i) the amount paid directly to the Company for the specific offering giving rise to the claim during the six (6) months preceding the event giving rise to liability, or (ii) one hundred U.S. dollars (US $100).
These limitations do not exclude or limit liability that cannot lawfully be excluded or limited.
21. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the Company and its owners, officers, employees, contractors, and agents from claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys’ fees arising from your violation of these Terms, violation of applicable law, misuse of the Services, or any allegation that your User Submissions infringe, misappropriate, or otherwise violate the rights of any third party.
This obligation does not apply to the extent a claim results from the Company’s own conduct for which indemnification cannot lawfully be required.
22. Suspension and Termination
We may suspend or terminate your access to the Services if you violate these Terms, fail to make a required payment, misuse the Services, threaten the security or operation of the Services, infringe another person’s rights, or engage in conduct that may expose the Company or others to harm or liability.
You may stop using the Services at any time. Termination does not eliminate payment obligations accrued before termination. Provisions that by their nature should survive termination will remain effective, including provisions concerning ownership, licenses, disclaimers, liability, indemnification, and dispute resolution.
23. Governing Law and Venue
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.
Subject to the arbitration provisions below, any legal action arising from or related to these Terms or the Services must be brought in a state or federal court having jurisdiction in Fairfax County, Virginia. Each party consents to personal jurisdiction and venue in those courts.
Nothing in these Terms deprives a consumer of mandatory protections provided by the law of the consumer’s country or state of residence when those protections cannot be waived by contract.
24. Arbitration and Class-Action Waiver
Any dispute arising from or relating to these Terms will be resolved through binding individual arbitration rather than in court, except that either party may pursue an eligible claim in small-claims court or seek temporary injunctive relief concerning unauthorized use or infringement of intellectual property. The arbitration will be administered by the American Arbitration Association ("AAA") in accordance with the AAA’s Commercial Arbitration Rules and the Supplementary Procedures for Commercial Related Disputes (the "AAA Rules"), as modified by these Terms. The arbitration will take place in Fairfax County, Virginia.
You and the Company agree that claims may be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, coordinated, mass, or representative proceeding. Neither an arbitrator nor a court may combine more than one person’s claims unless both parties agree in writing.
Any cause of action or claim you may have arising out of or relating to these Terms or the Site must be commenced within one (1) year after the cause of action accrued, otherwise, such cause of action or claim is permanently barred.
25. General Terms
The Company shall not be liable for any delay, interruption, or failure to perform resulting from events beyond its reasonable control, including acts of God, natural disasters, epidemics, pandemics, governmental actions, labor disputes, power failures, internet or telecommunications interruptions, cyberattacks, failures of third-party service providers, or other similar events.
These Terms, the Privacy Policy, and any applicable offering-specific terms constitute the entire agreement between you and the Company concerning the Services.
If a provision is found unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a merger, reorganization, financing, sale of assets, or similar transaction.
All headings used in the Terms are intended for convenience of reference only and shall not affect the construction or interpretation of the Terms. Words of any gender used in the Terms shall be held to include any other gender, and words in the singular shall be held to include the plural when the sense requires.
No person other than you and the Company has a right to enforce these Terms, except where applicable law expressly provides otherwise.
